1. Acceptance of these terms
Welcome. This website, tdangrycubes.com (the "Website"), is operated by BHN Consulting Inc. ("we," "us," or "our"), the developer and publisher of the video game Angry Cubes. By accessing or using the Website you accept and agree to these Terms of Use and our Privacy Policy. If you do not agree, please do not use the Website. These terms apply to the Website only — any future availability of Angry Cubes on platforms such as Steam or Xbox will be governed by those platforms' own terms and any end-user license agreement that ships with the game.
2. Changes to these terms
We may revise these terms from time to time, for example when the Website gains new features. The current version, with its effective date, will always be posted on this page, and changes apply from the moment they are posted. Your continued use of the Website after a change means you accept the revised terms. We will keep the terms readable and will summarize material changes in plain language at the top of this page when they occur.
3. Availability of the Website
We may update, change, suspend, or discontinue any part of the Website at any time without notice. We do not guarantee that the Website, or any content on it, will always be available, uninterrupted, or error-free, and we will not be liable if all or part of it is unavailable at any time.
4. Intellectual property ownership
The Website and everything on it — including the Angry Cubes name and logo, the game, its characters (including the Happy Helpers and the Angry Cubes themselves), artwork, screenshots, video, music, text, page designs, and underlying code — are owned by or licensed to BHN Consulting Inc. and are protected by copyright, trademark, and other intellectual-property laws of the United States and other countries. Except for the limited licenses in Sections 5 and 6, no right, title, or interest in the Website or its content is transferred to you by browsing or downloading. All rights not expressly granted are reserved. Third-party materials used in the game are credited on our Licenses page.
5. Your license to use the Website
We grant you a personal, non-exclusive, non-transferable, revocable license to view the Website and to download and print its pages for your own personal, non-commercial use. This license does not permit you to resell Website content, compile it into datasets, or exploit it commercially outside the press permissions below.
6. Press-kit license
We want press, creators, and partners to cover Angry Cubes, so we grant a broader license for the materials on our Press kit page (the "Press Materials"):
- You may download, reproduce, crop, resize, and embed the Press Materials in articles, videos, streams, social posts, newsletters, and similar editorial coverage about Angry Cubes, including in monetized coverage.
- You may not sell the Press Materials themselves, use them in another product or brand, present them in a way that falsely implies our sponsorship or endorsement of an unrelated product or message, materially distort them (beyond ordinary cropping, resizing, and commentary), or remove credits or notices embedded in them.
- Uses outside normal editorial coverage — merchandising, advertising something else, AI-training datasets — require our prior written permission via bryan@tdangrycubes.com.
7. Prohibited uses
You agree not to use the Website:
- in any way that violates applicable law or regulation;
- to attempt unauthorized access to, interfere with, damage, or disrupt the Website, its security features, or the infrastructure it runs on;
- to introduce viruses, malware, or other harmful material;
- to conduct denial-of-service attacks, aggressive automated scraping that burdens the service, or bulk harvesting of content;
- to impersonate us, our staff, or any other person, or to misrepresent your affiliation;
- to send unlawful, deceptive, or abusive submissions through the contact form, or to spam it.
Ordinary, reasonable automated access — such as search-engine indexing and archiving — is welcome.
8. Contact form
The contact form exists so real people can reach us about Angry Cubes. By submitting it you confirm the information you provide is accurate, that you are entitled to share it, and that your message does not contain unlawful content or anyone else's confidential information. How submissions are handled, protected, and deleted is described in our Privacy Policy and on the Data & Security page. Unsolicited game pitches or creative ideas sent to us do not create any confidentiality or compensation obligation on our part.
9. Information about a game in development
Angry Cubes is in active development. Everything on this Website — features, helper rosters, battlefield counts, artwork, platforms, timing — describes the current state of the project and may change before release. Nothing on this Website is a promise of release on any platform or date, a guarantee of certification or approval by any platform holder, or a statement of final pricing, ratings, or availability. Content on the Website is provided for general information and entertainment; while we work to keep it accurate, we do not warrant its completeness or reliability, and you rely on it at your own discretion.
10. Third-party platforms and links
The Website may reference or link to third-party platforms and resources, including Steam and Xbox. Those services have their own terms and privacy practices, which we do not control and are not responsible for. Xbox is a trademark of Microsoft. Steam is a trademark of Valve Corporation. All third-party names and marks belong to their owners; their appearance here is referential and does not imply any affiliation with, or endorsement of or by, BHN Consulting Inc.
11. Privacy
Our Privacy Policy — including its zero-cookie, zero-tracking commitments and your deletion rights — is part of these terms. Because the Website sets no cookies and runs no trackers, there is no consent banner and nothing for you to configure.
12. Disclaimer of warranties
THE WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE WEBSITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
13. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BHN CONSULTING INC., ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL — ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE WEBSITE OR ITS CONTENT, EVEN IF FORESEEABLE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE WEBSITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU; IN THAT CASE OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT THE LAW ALLOWS.
14. Indemnification
You agree to defend, indemnify, and hold harmless BHN Consulting Inc. and its officers, employees, and agents from claims, damages, and reasonable attorneys' fees arising out of your violation of these terms or your misuse of the Website or Press Materials.
15. Governing law and venue
These terms and any dispute arising out of them or the Website are governed by the laws of the State of Hawai'i and the United States, without regard to conflict-of-law rules. Any legal action relating to the Website will be brought exclusively in the state or federal courts located in Hawai'i, and you consent to their jurisdiction, except that either party may seek injunctive relief for intellectual-property misuse in any court of competent jurisdiction.
16. Severability, waiver, and entire agreement
If any provision of these terms is held invalid or unenforceable, the remaining provisions continue in full force. Our not enforcing a provision is not a waiver of it. These terms and the Privacy Policy are the entire agreement between you and us regarding the Website and supersede all prior understandings about it.
